2. Scope of These Terms
These Terms apply to all SiteHeros services, including but not limited to managed WordPress hosting, domain registration and domain-related services, client portal access, hosting dashboard access, website design services, website development services, Elite Management services, website maintenance services, WordPress configuration services, migration services, SEO setup services, performance optimization services, security-related services, content upload or content support services, one-off projects, development-on-demand services, add-on services, support services, community or forum resources where applicable, and any other service, product, plan, package, or subscription provided under the SiteHeros brand.
Additional service-specific terms may apply to certain services. If there is a conflict between these Terms and a written service agreement, proposal, order form, statement of work, addendum, or service-specific policy, the more specific document will control for that specific service.
3. Services Covered by These Terms
SiteHeros provides premium managed WordPress hosting, domain hosting, website design, website management, and related website services.
SiteHeros services may include:
- High-frequency managed WordPress hosting
- Dedicated or resource-isolated hosting environments
- Domain registration or domain management services
- WordPress installation, setup, configuration, and migration
- Client portal access and Business Toolkit access
- Website monitoring, security tools, backup tools, and performance tools
- Maintenance, website edits, design, redesign, and development services
- Premium template-based website builds, custom template builds, and custom development
- Elementor-based builds and HTML, CSS, or JavaScript work where applicable
- Blog setup, forms, integrations, analytics setup, and search visibility setup
- Content upload or content creation where included
- Elite Management services and ongoing website operations support
SiteHeros may add, change, remove, improve, suspend, or discontinue services, service features, plans, or tools at any time, subject to applicable law and any active written service agreement.
4. Eligibility and Account Responsibilities
To use SiteHeros services, you must be able to enter into a legally binding agreement.
If you use SiteHeros on behalf of a business, organization, school, nonprofit, government-related entity, department, or other legal entity, you represent that you have authority to bind that entity to these Terms.
You are responsible for:
- Providing accurate account information
- Keeping your contact information current
- Maintaining the confidentiality of your login credentials
- Securing your email account and devices
- Reviewing billing details before purchase
- Monitoring notices from SiteHeros
- Ensuring your use of services complies with applicable laws
- Ensuring anyone you authorize to access your account complies with these Terms
You are responsible for all activity under your account, including activity by employees, contractors, administrators, collaborators, clients, representatives, or other users you authorize.
5. Client Portal and Account Access
SiteHeros may provide access to a white-labeled client portal, dashboard, account area, hosting panel, billing area, support area, or related management interface.
Client portal features may include hosting plan access, website management tools, domain-related tools, billing details, invoices, payment methods, support access, project or service information, site management options, account settings, subscription management, and additional tools made available by SiteHeros.
You agree not to share portal access with unauthorized users, attempt to access another clientβs account or site, circumvent account permissions, interfere with portal operations, use the portal for unlawful or abusive activity, reverse engineer or scrape dashboard functionality, or upload malicious files, malware, unauthorized scripts, or unauthorized code.
SiteHeros may suspend, restrict, or revoke portal access if we believe your account has been compromised, used improperly, involved in prohibited activity, or presents a security, legal, billing, operational, or provider risk.
6. Hosting Services
SiteHeros provides managed WordPress hosting services designed for WordPress websites.
Hosting plans may include managed WordPress hosting, high-frequency hosting infrastructure, dedicated or resource-isolated hosting resources depending on plan, WordPress setup, SSL support, backup tools, security tools, performance tools, monitoring tools, migration support, client portal access, server location selection where available, staging tools where available, and Business Toolkit access where available.
Hosting resources, storage, bandwidth, visits, CPU, memory, object cache, CDN, backups, staging, support level, and other features may vary by plan.
You are responsible for selecting a hosting plan that fits your websiteβs needs. SiteHeros may recommend a different plan if your site exceeds plan limits, causes performance issues, creates security risks, or requires additional resources.
SiteHeros may require you to upgrade, optimize, reduce usage, remove problematic content, fix code, change configurations, or take corrective action if your site negatively impacts platform performance, security, stability, providers, or other clients.
7. Domain Services
SiteHeros may provide domain registration, domain renewal, domain transfer, domain management, DNS support, domain connection, or domain-related services through third-party registrars, reseller platforms, registry providers, or domain service providers.
By purchasing or using domain services, you understand and agree that:
- Domain registrations are subject to registrar, registry, ICANN, reseller, and provider rules.
- Domain availability is not guaranteed until registration is completed.
- Domain pricing and renewal pricing may change.
- Some domain transactions may be final or non-refundable.
- Failure to renew may result in expiration, redemption fees, loss of domain control, or domain deletion.
- You are responsible for keeping domain contact and billing information accurate.
- You are responsible for reviewing spelling before registering a domain.
SiteHeros is not responsible for domains lost due to inaccurate information, failed payment, expiration, registry action, registrar action, reseller action, provider action, or client inaction.
8. Elite Management Services
Elite Management is a premium SiteHeros service designed for clients who want SiteHeros to operate as their website manager, WordPress super-admin, website department, or ongoing web operations partner.
Elite Management may include hosting setup, domain setup, WordPress setup, plugin and tool configuration, theme configuration, Elementor setup, website design, website builds, premium template builds, custom template builds, WordPress management, website maintenance, updates, security checks, performance checks, backup monitoring, site fixes, content upload, content creation where included, blog setup, SEO setup, analytics setup, social connection support where included, revisions, reports, technical recommendations, and ongoing website support.
Elite Management is not unlimited labor unless expressly stated in a written agreement.
Each Elite Management plan or package may include defined service levels, limits, response expectations, included tasks, excluded tasks, monthly allowances, revision limits, project boundaries, or support boundaries.
Work outside the included scope may require a separate quote, add-on purchase, higher service tier, written statement of work, hourly billing, development-on-demand billing, or separate project agreement.
9. Website Design, Development, and Project Services
SiteHeros may provide website design, redesign, development, setup, customization, migration, landing page, template, and project-based services.
Project services may be based on written proposals, service packages, order forms, statements of work, email approvals, client portal submissions, intake forms, agreed task requests, or written service descriptions.
Unless otherwise stated in writing, project timelines depend on client responsiveness, timely content delivery, timely asset delivery, access to required accounts, feedback turnaround, scope complexity, third-party tool availability, payment status, technical constraints, revision cycles, and required approvals.
SiteHeros is not responsible for delays caused by missing content, delayed approvals, third-party outages, unavailable access, unclear instructions, payment issues, revision delays, change requests, client-side changes, or provider limitations.
10. Maintenance, Add-Ons, and One-Off Services
SiteHeros may offer maintenance services, add-on services, and one-off services for clients hosted with SiteHeros.
These services may include website updates, plugin updates, theme updates, WordPress core updates, security checks, performance checks, minor fixes, content edits, page updates, landing pages, forms, integrations, SEO setup, analytics setup, blog setup, troubleshooting, development support, and technical consultation.
Maintenance services are not a guarantee that a website will never break, be attacked, experience downtime, lose rankings, experience plugin conflicts, or require additional development.
One-off services are limited to the scope purchased or agreed. Additional requests may require additional billing.
11. Client Responsibilities
Clients are responsible for:
- Providing accurate account and billing information
- Selecting appropriate services and reviewing service descriptions before purchase
- Providing required website content, media, logins, approvals, and instructions
- Ensuring they have legal rights to all submitted content
- Maintaining business licenses, policies, and compliance obligations
- Reviewing website content for accuracy
- Reviewing legal pages with qualified counsel when necessary
- Responding to SiteHeros requests in a timely manner
- Keeping third-party accounts in good standing
- Maintaining email access and account security
- Following acceptable use requirements
- Paying invoices and subscription charges on time
- Not misusing hosting, domains, tools, portal access, or support
If you provide access credentials to SiteHeros, you are responsible for ensuring that such access is authorized and appropriate. SiteHeros recommends using role-based access, temporary credentials, or secure access-sharing methods where possible.
12. Content, Materials, and Access Provided by Clients
You represent and warrant that all content, materials, data, images, text, video, audio, trademarks, logos, brand assets, documents, files, credentials, instructions, and other materials you provide to SiteHeros are accurate, lawful, and properly authorized.
You retain ownership of content you provide, subject to the rights you grant SiteHeros to perform services.
You grant SiteHeros a limited license to use, copy, modify, publish, display, configure, migrate, process, host, transmit, back up, and otherwise handle your materials as reasonably necessary to provide services.
You are responsible for ensuring that your website content does not violate laws, intellectual property rights, privacy rights, advertising rules, consumer protection laws, accessibility requirements, industry regulations, contractual obligations, platform rules, or third-party rights.
13. Billing, Payments, and Taxes
SiteHeros may charge for services through online checkout, recurring subscription billing, invoices, client portal billing, Stripe payment processing, reseller billing tools, or other authorized payment methods.
By purchasing a service, you authorize SiteHeros and its payment processors, billing providers, reseller platforms, or authorized service providers to charge the payment method you provide for applicable fees, renewals, taxes, add-ons, overages, upgrades, domain fees, and other amounts due.
You agree to provide accurate billing information, keep payment methods current, pay charges when due, review plan details before purchase, review renewal terms, pay applicable taxes unless exempt, notify SiteHeros promptly of billing issues, and maintain access to the email account used for billing and service notices.
Failure to pay may result in service suspension, cancellation, loss of access, late fees where permitted, domain expiration, project pause, termination, or loss of related tools or features.
14. Subscription Services and Renewals
Some SiteHeros services renew automatically unless cancelled according to the applicable cancellation process.
Recurring services may include hosting plans, domain services, Elite Management plans, maintenance plans, add-on subscriptions, support subscriptions, website management services, and other recurring services.
By purchasing a recurring service, you authorize recurring charges until the service is cancelled.
Cancellation does not automatically entitle you to a refund unless the refund is required by law or permitted under the SiteHeros Refund and Cancellation Policy.
You are responsible for cancelling services before renewal if you do not want to be charged again.
15. Refunds and Cancellations
SiteHeros offers a 30-day refund window as described in the SiteHeros Refund and Cancellation Policy.
Refund eligibility may vary based on service type.
Some services may be non-refundable or partially refundable, including domain registrations, domain renewals, domain transfers, completed work, custom development, completed design work, setup fees, third-party costs, purchased assets, paid licenses, emergency work, rush work, work already performed, and services outside the refund window.
Cancelling hosting, domain, or management services may affect website availability, DNS, email routing, backups, files, databases, licenses, tool access, and portal access.
Before cancellation, you are responsible for exporting or requesting access to your data, website files, content, and other materials where applicable.
16. Free Migrations and Onboarding
SiteHeros may offer free migrations into SiteHeros hosting. Free migration eligibility, scope, and timing may vary.
A free migration may include moving an existing WordPress website from another host to SiteHeros hosting, subject to technical feasibility and access availability.
Free migrations may not include redesigns, malware cleanup unless included, complex rebuilds, custom development, fixing pre-existing website issues, SEO recovery, email migration unless included, non-WordPress migration unless approved, large custom application migration, third-party platform migration, or extensive troubleshooting unrelated to migration.
SiteHeros may refuse or limit a migration if the source site is infected, unstable, unlawful, inaccessible, technically incompatible, excessively large, or outside the intended scope.
17. Third-Party Services, Tools, and Platforms
SiteHeros relies on third-party services, platforms, software, processors, infrastructure providers, plugins, themes, tools, templates, analytics systems, payment processors, registrars, and integrations.
These may include WPMU DEV / Incsub, Stripe, Google Analytics, Google Tag Manager, Google Search Console, Google reCAPTCHA, Elementor, Envato Elements, Astra / Brainstorm Force, Ultimate Multisite, WordPress.org, Automattic-related WordPress ecosystem services where applicable, bbPress where applicable, domain registrars and registry providers, DNS providers, and email, analytics, performance, security, and support tools.
Third-party services are subject to their own terms, privacy policies, service limits, outages, updates, pricing, and operational rules.
SiteHeros is not responsible for third-party outages, bugs, pricing changes, discontinued services, policy changes, licensing changes, vulnerabilities, data practices, account actions, or provider restrictions.
18. WordPress, Plugins, Themes, Templates, and Licenses
SiteHeros works primarily with WordPress and related plugins, themes, builders, templates, and tools.
You understand that WordPress websites commonly depend on third-party software. Updates, conflicts, bugs, vulnerabilities, licensing changes, discontinued plugins, PHP changes, theme changes, or hosting environment changes may affect website behavior.
Unless otherwise stated in writing, SiteHeros does not guarantee lifetime access to any specific third-party plugin, theme, license, asset, or template. Some tools may only be available while hosted with SiteHeros or subscribed to an eligible plan. Some licenses may be owned or controlled by SiteHeros and not transferred to the client. Some templates or assets may be subject to third-party license restrictions.
If a client leaves SiteHeros, certain managed tools, licenses, features, dashboards, Business Toolkit functionality, or white-labeled platform benefits may no longer be available.
19. Acceptable Use and Prohibited Activity
You agree not to use SiteHeros services for unlawful, abusive, harmful, fraudulent, or prohibited activity.
Prohibited activity includes malware, phishing, spam, botnets, credential theft, unauthorized scanning, hacking, exploiting vulnerabilities, denial-of-service activity, hosting illegal content, infringing intellectual property, fraudulent schemes, misleading impersonation, child exploitation or abusive material, harassment or threats, excessive resource abuse, cryptocurrency mining without written permission, pirated content, sending unsolicited bulk email, bypassing security controls, interfering with other clients or infrastructure, violating provider rules, reselling services without authorization, or using SiteHeros infrastructure for non-website abuse, evasion, or automation activity.
Additional restrictions may appear in the SiteHeros Acceptable Use Policy. SiteHeros may suspend or terminate services immediately if prohibited activity is suspected or confirmed.
20. Security, Backups, and Updates
SiteHeros may provide security tools, monitoring, backups, update support, and related services depending on the plan or service purchased.
However, no website, hosting environment, backup system, security tool, or monitoring system is guaranteed to be completely secure, uninterrupted, error-free, or immune from data loss.
Clients remain responsible for using strong passwords, protecting administrator access, avoiding unsafe plugins or themes, reviewing user roles, avoiding unauthorized code, maintaining secure third-party accounts, following SiteHeros security guidance, and keeping business-critical offline copies where appropriate.
Backups may be limited by plan, retention period, storage limits, technical constraints, or third-party provider rules.
21. Service Availability and Performance
SiteHeros aims to provide high-quality, high-performance managed WordPress hosting and website services.
However, SiteHeros does not guarantee that services will be uninterrupted, error-free, immune from downtime, or compatible with every plugin, theme, integration, script, or third-party service.
Service availability and performance may be affected by maintenance, updates, third-party outages, DNS issues, registrar issues, payment issues, security incidents, traffic spikes, plugin conflicts, theme conflicts, client code, malware, database issues, external APIs, internet routing, force majeure events, client misconfiguration, resource overuse, platform limitations, or provider limitations.
SiteHeros may perform maintenance, updates, migrations, optimizations, security actions, or infrastructure changes when needed.
22. Support Scope
SiteHeros support scope depends on the service or plan purchased.
Hosting support may include reasonable assistance with hosting access, basic WordPress hosting issues, SSL, backups, migration issues, basic DNS guidance, platform questions, client portal questions, and plan-related questions.
Elite Management support may include broader operational support depending on the selected tier.
Excluded or separately billable support may include custom development, advanced debugging, third-party account support, copywriting unless included, graphic design unless included, SEO strategy unless included, paid ad management, email inbox support unless included, malware cleanup unless included, rebuilding broken third-party code, fixing unsupported plugins, work outside plan scope, emergency rush work, business consulting unless included, and legal, tax, medical, financial, insurance, accounting, or regulated professional advice.
23. Ownership and Intellectual Property
Unless otherwise stated in writing, clients retain ownership of their own original content, brand assets, logos, text, images, videos, and materials provided to SiteHeros.
SiteHeros retains ownership of SiteHeros brand assets, processes, internal systems, internal templates, reusable components, code libraries, design systems, service methods, documentation, frameworks, non-client-specific tools, Business Toolkit configurations, proprietary workflows, and pre-existing intellectual property.
For custom work created specifically for a client, ownership rights may depend on the project agreement, payment status, third-party licensing, and the nature of the work.
Unless otherwise agreed in writing, final client-specific website content and custom deliverables may be transferred or made available after full payment, excluding SiteHeros proprietary tools, platform licenses, reusable systems, third-party licenses, internal methods, and non-transferable third-party assets.
24. Portfolio, Case Study, and Marketing Use
Unless prohibited in writing, SiteHeros may reference completed client work in portfolios, case studies, marketing materials, proposals, social posts, or website examples.
This may include client name, website URL, public screenshots, general project description, before-and-after performance improvements, general service category, and publicly visible website elements.
SiteHeros will not intentionally disclose confidential business information, private credentials, non-public analytics, private strategy, or sensitive data without permission.
Clients may request in writing that SiteHeros not use their project in marketing materials.
25. Confidentiality
During service delivery, either party may receive confidential information.
Confidential information may include login credentials, business plans, private documents, non-public project details, technical information, customer data, internal systems, financial information, unpublished content, security information, and account access details.
Each party agrees to use reasonable care to protect confidential information and to use it only as needed to perform obligations or exercise rights under these Terms.
Confidentiality obligations do not apply to information that is public, independently developed, already known without restriction, lawfully received from another source, or required to be disclosed by law.
26. Privacy and Data Protection
SiteHeros handles personal information according to the SiteHeros Privacy Policy.
By using SiteHeros services, you agree that SiteHeros may collect, process, store, transmit, and use information as described in the Privacy Policy.
SiteHeros may process client, account, billing, support, website, analytics, hosting, domain, project, and service data as necessary to provide services.
Clients are responsible for their own website privacy practices, including privacy policies, cookie notices, consent tools, data collection disclosures, and compliance with laws that apply to their business, visitors, users, customers, students, members, patients, donors, or other audiences.
SiteHeros does not provide legal advice. Clients should consult qualified legal counsel for privacy, data protection, accessibility, advertising, regulated industry, or compliance obligations.
27. Compliance With Laws
You are responsible for ensuring your website, business, content, products, services, data collection, communications, and use of SiteHeros comply with all laws and regulations that apply to you.
This may include privacy laws, consumer protection laws, advertising laws, accessibility laws, email marketing laws, payment laws, tax laws, education-related rules, childcare-related rules, nonprofit rules, healthcare-related rules, financial regulations, intellectual property laws, data protection laws, industry-specific requirements, and contractual obligations with your customers or users.
SiteHeros may refuse or discontinue service if we believe a website, project, request, or client activity creates legal, compliance, security, reputational, operational, or provider risk.
28. Disclaimers
SiteHeros services are provided on an βas availableβ and βas providedβ basis unless otherwise stated in writing.
SiteHeros does not guarantee uninterrupted service, error-free operation, perfect security, complete protection from attacks, specific search engine rankings, specific traffic levels, specific conversion rates, specific sales results, specific business outcomes, compatibility with every plugin or theme, permanent availability of third-party tools, discovery of all website issues, specific performance scores, or complete accessibility or legal compliance without professional review.
SiteHeros may provide technical, operational, SEO, design, website, and business-related recommendations, but SiteHeros does not provide legal, tax, accounting, medical, financial, insurance, or regulated professional advice.
29. Limitation of Liability
To the maximum extent permitted by law, SiteHeros, Good Ground Serves LLC, its owners, employees, contractors, affiliates, vendors, service providers, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.
This includes damages for lost profits, lost revenue, lost business opportunities, lost data, loss of goodwill, website downtime, search ranking changes, conversion loss, third-party service failures, domain expiration, security incidents, malware, plugin conflicts, theme conflicts, data loss, business interruption, unauthorized access, client mistakes, delayed projects, failed payments, inability to access services, provider policy changes, and tool or license changes.
To the maximum extent permitted by law, SiteHeros total liability for any claim will not exceed the amount you paid to SiteHeros for the specific service giving rise to the claim during the three months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
30. Indemnification
You agree to indemnify, defend, and hold harmless SiteHeros, Good Ground Serves LLC, its owners, employees, contractors, affiliates, vendors, service providers, and representatives from claims, damages, losses, liabilities, costs, and expenses arising from:
- Your use of SiteHeros services
- Your website content, products, or services
- Your violation of these Terms or applicable law
- Your infringement of third-party rights
- Your misuse of hosting or domain services
- Your failure to secure your account
- Your instructions to SiteHeros
- Materials you provide
- Data you collect from website visitors
- Your business practices, customer disputes, regulatory obligations, or third-party accounts
- Your failure to obtain required permissions, consents, licenses, or approvals
31. Suspension or Termination of Services
SiteHeros may suspend or terminate services if payment fails, invoices are overdue, you violate these Terms, you violate acceptable use rules, your site presents a security risk, your site causes performance issues, your domain or hosting activity creates provider risk, you provide false information, you misuse support, you engage in abusive conduct, you use services for unlawful activity, required access or approvals are not provided, third-party providers require suspension, or continuing service creates legal, operational, reputational, or security risk.
Suspension or termination may affect access to websites, hosting, domains, portal features, billing, support, files, databases, backups, tools, and managed licenses.
You remain responsible for amounts due before suspension or termination.
32. Changes to Services or Terms
SiteHeros may update these Terms from time to time.
Changes may be made to reflect new services, changed business practices, legal requirements, third-party provider changes, platform changes, billing changes, security updates, operational updates, and tool or license changes.
The updated Terms will be posted on the SiteHeros website or otherwise made available.
Continued use of SiteHeros services after changes are posted means you accept the updated Terms.
33. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.
Any dispute arising from or related to these Terms, SiteHeros services, or Good Ground Serves LLC will be handled in the courts located in North Carolina, unless another dispute resolution process is required by applicable law or agreed in writing.
